Terms of use
A few things
to agree on.
Last updated
These terms are the agreement between you and us for the Raumo app, Raumo Plus, shared links and this website. We have tried to keep them short and plain. Nothing in them takes away the rights the law gives you as a consumer.
- You may use Raumo on the Apple devices you own or control. Raumo Plus is sold and billed by Apple.
- The music is for your own listening. Sharing links, and short clips made with the app, is welcome, as long as you say they are from Raumo.
- A shared link is public to anyone who has it. Keep it lawful and kind; we remove links that break the rules.
- Raumo is music, not medicine.
This agreement
Raumo is published by the person named below (“we”, “us”):
Oliver Michael BuchmannSchärenmoosstrasse 99 8052 Zürich SwitzerlandEmail: support@raumo.appThese terms apply when you download or use the Raumo app for iPhone, with its widgets, controls and Live Activity, when you buy Raumo Plus, when you make or open a shared link, and when you use raumo.app. They are the licence agreement for the app. Where you obtained Raumo from the App Store, they take the place of Apple’s standard licence agreement.
The agreement is between you and us only, not with Apple. We alone are responsible for Raumo and its content. Our privacy policy explains how we handle data. It is information, not part of this contract.
Your licence to use Raumo
We give you a personal, non-exclusive, non-transferable licence to use Raumo on any Apple device you own or control, as the App Store’s Usage Rules allow. This includes other members of your Family Sharing group. The licence lasts as long as this agreement.
Raumo’s software, sound design, artwork, names and logos belong to us or to those who licensed them to us. You may not:
- copy, rent, lend, sell, redistribute or sublicense the app;
- extract, collect or reuse its sound sources, samples, recordings, artwork or musical recipes outside the app, except as these terms allow for the music;
- decompile, reverse engineer or modify the app, except where the law permits it and that permission cannot be excluded;
- get around Raumo Plus or any technical limit, or use the share service in an automated way or to overload it; or
- use Raumo in a way that breaks the law or harms others.
Raumo uses open-source software and sound sources from other creators. They are credited, with their licences, under Settings › Acknowledgements in the app. Their licences apply to those parts and take precedence where they give you more rights.
Raumo Plus
Raumo is free to download and use. Raumo Plus adds more playlists, scenes, rooms and longer listening. The app shows what is free and what Plus includes before you buy. We offer it in three forms:
- Monthly or yearly: a subscription that renews automatically at the end of each period unless you cancel it.
- Forever: a one-time purchase with no renewal.
Buying and paying
Apple sells Raumo Plus on our behalf and charges your Apple Account. The price, period and any free trial are shown on the purchase screen and in the App Store in your currency, including taxes where they apply. The purchase is completed when you confirm it with Apple. Apple’s Media Services Terms also apply to the purchase.
Free trial
Where we offer a free trial, the subscription begins with it. At the end of the trial it turns into a paid subscription and is charged, unless you cancel at least 24 hours before the trial ends. If you allow it, the app reminds you the day before. If you cancel during a trial, Apple may end the trial at once.
Renewal and cancellation
Apple charges each renewal within the 24 hours before the current period ends. You can cancel at any time in your Apple Account settings (on iPhone: Settings › [your name] › Subscriptions, or as Apple describes here). To avoid the next charge, cancel at least 24 hours before the period ends. After you cancel, Plus stays active until the end of the period you paid for. If we change the price, Apple tells you in advance and, where the law or Apple’s rules require it, asks you to agree.
Refunds and withdrawal
Apple handles payment, so refunds and any statutory right of withdrawal are handled by Apple under its terms. Request them at reportaproblem.apple.com. We cannot issue refunds ourselves, because we never receive your payment details. This does not limit your statutory rights against us if Raumo Plus is defective (see Your statutory rights).
Family Sharing, restoring and when Plus ends
Where the purchase screen shows it, Raumo Plus can be shared with your Family Sharing group. To use Plus on a new device, choose Restore Purchases. When Plus ends, nothing you made or kept is deleted. Only the Plus features pause, and they return when Plus is active again.
The music and what you may do with it
Raumo composes its music on your device from our software and from sound sources: our own, recordings released into the public domain, and others licensed to us. Each performance is new, and recipes you keep may sound different after an engine update. The app tells you when that is the case.
You may:
- listen to Raumo privately, at home, at work, in your studio, while you study, sleep, read or meditate;
- share links to soundscapes; and
- share short clips made with the app’s own clip feature, or short screen recordings of Raumo, on social media and in messages, without charge to viewers. Each clip must say that it comes from Raumo, with a link to raumo.app where the medium allows.
Without our written permission, you may not use Raumo’s music or sounds commercially or in public, or publish longer recordings of them. This includes:
- background music in shops, offices open to the public, venues, events, broadcasts or podcasts;
- monetised videos or live streams;
- selling or releasing recordings, or registering them with Content ID or similar systems;
- building sample, loop or stock-music libraries from them; and
- training or testing AI models with them.
If you want to do any of these, ask us at support@raumo.app. We are happy to hear what you have in mind.
What you write in Raumo, such as names and notes, belongs to you.
Shared links
When you choose Share, Raumo sends the soundscape’s name, its musical recipe and a picture of its artwork to raumo.app. We publish them at a link that anyone who has it can open. The privacy policy explains exactly what is sent.
Your responsibility
You are responsible for the name you share. It must not:
- be unlawful, or infringe anyone’s rights, such as copyright, trademarks or personality rights;
- contain anyone’s personal information, including your own, such as names with addresses, phone numbers or email addresses;
- insult, threaten, harass or discriminate against anyone, or incite violence or hatred;
- be sexually explicit, or harmful to children;
- advertise, spam or link to other services; or
- impersonate Raumo, us or anyone else.
Permission you give us
You allow us to store, copy and show the name, recipe and picture of each link free of charge, worldwide, and only to run the link and to let recipients open it in Raumo. This permission ends when the link is deleted. Copies others already made are not affected.
How we moderate
We do not check links before they are published. The share service shortens names to 80 characters, removes control characters and limits how many links a device or network can make. Beyond that, a person reviews every report we receive and anything we notice ourselves. We use no automated tools to decide on content.
If a link breaks these rules or the law, we may delete it. If someone repeatedly or seriously misuses sharing, we may stop their device from making links. We decide carefully and in proportion, and we consider the rights and interests of everyone involved, including freedom of expression. Raumo has no accounts, so we usually cannot tell you that a link was removed. Where we can reach you, we tell you what we did and why, and how you can challenge it. You can always write to us to have a decision reviewed.
How long links last
A link stays until you delete it in Settings › Listening › Links you shared, or until we remove it under these terms. We may end the share service as a whole. If we do, we announce it in the app and on this website at least 30 days in advance.
Reporting a shared link
If you believe a shared link is unlawful or breaks these rules, write to support@raumo.app. Please include:
- the link (raumo.app/t/…);
- why you believe it is unlawful or against these rules, as precisely as you can;
- your name and email address, unless your report concerns the sexual abuse of children; and
- a statement that you believe in good faith that your report is accurate and complete.
We confirm receipt, review the report promptly and carefully, and tell you what we decided and how you can challenge it. Where content suggests a threat to someone’s life or safety, we inform the authorities.
Contact for authorities and users: the same address is our single point of contact under Articles 11 and 12 of the EU Digital Services Act, and our contact point for removal orders under the EU Regulation on terrorist content online. We accept messages in English and German.
Listening safely
Raumo is for listening and relaxation. It is not a medical device, and it does not diagnose, treat or prevent any illness, including sleep or attention disorders. If you have health concerns, please see a doctor.
Listen at a moderate volume: loud sound over long periods can damage your hearing. Do not use headphones or deeply relaxing music when you need to pay attention to your surroundings, such as while driving, cycling or operating machinery. The sleep timer only fades the music; it measures nothing about you.
Updates and changes to Raumo
We keep Raumo working on current versions of iOS and provide updates, including security updates, as the law requires for the period you are entitled to them. To get them, install updates when the App Store offers them. Raumo runs on the iPhone models and iOS versions stated in the App Store.
We may improve and change Raumo, for example to add soundscapes, refine the engine, or keep it compatible and secure. We do not make changes that significantly reduce what you have already paid for, unless there is a valid reason, such as a legal requirement, security or a third party withdrawing a licence. If we do, we tell you clearly in good time. If you have a subscription and such a change significantly impairs your use of Raumo Plus, you may end it free of charge within 30 days of the change, or of being told about it, whichever is later. Where the law gives you further rights, those apply.
Your statutory rights
If you pay for Raumo Plus, the statutory warranty rights for digital content and digital services apply in full. If you are a consumer in the EU, these include the rights under the law of your country implementing the EU Digital Content Directive (EU) 2019/770. Contact us if something does not work as described; we will try to fix it quickly.
The free version is provided without charge. For it, the statutory rules for free-of-charge contracts apply, and we do not promise that it will meet particular needs or always be available.
If Raumo fails to meet a warranty that applies by law, you may also notify Apple, and Apple will refund the purchase price to you. Beyond that, to the extent the law allows, Apple has no warranty obligation for Raumo.
Liability
We are liable without limitation:
- for damage we cause intentionally or through gross negligence;
- for injury to life, body or health;
- under product liability law; and
- where we have given a guarantee or fraudulently concealed a defect.
For other damage caused by slight negligence, we are liable only if we breach an essential obligation. An essential obligation is one that makes it possible to perform this agreement properly at all, and on which you may reasonably rely: for example, giving you working access to Raumo Plus once you have paid for it. In that case our liability is limited to the damage that was typical and foreseeable when the agreement was made. Otherwise, we are not liable for slight negligence.
These limits also protect the people who work for us. They do not change who must prove what, and they do not apply where the mandatory law of your country gives you more protection.
Apple
If you obtained Raumo from the App Store, the following also applies, as Apple requires:
- This agreement is between you and us, not Apple. We, not Apple, are solely responsible for Raumo and its content.
- Apple has no obligation to provide maintenance or support for Raumo. For help, contact us.
- We, not Apple, are responsible for any claims you or others have relating to Raumo or its use, including product liability claims, claims that Raumo does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If someone claims that Raumo or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country. You also confirm that you are not on any US Government list of prohibited or restricted parties.
- When you use Raumo, you must also comply with the terms of any third-party service you use with it, such as your wireless carrier.
- Apple and its subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right to enforce it against you as a third-party beneficiary.
Questions, complaints or claims about Raumo go to us, using the contact details above.
Ending this agreement
You can end this agreement at any time by deleting Raumo from your devices. A subscription must also be cancelled with Apple, as described above, or it will keep renewing. Delete your shared links before you delete the app; otherwise write to us and we will delete them.
We may end the agreement for an important reason, such as serious or repeated breaches of these terms. For a paid subscription, we may end it only for such a reason or as the law otherwise allows. Where we end it without fault on your part, you keep what you paid for until the end of the period.
Changes to these terms
We may update these terms, for example when Raumo gains new features or the law changes. The new version and its date will appear here. Changes for the future that do not affect your existing purchase or subscription apply when you next use Raumo after they are published.
A change that would affect an existing paid subscription to your disadvantage applies only if you agree to it. We will not treat your silence as agreement. If you do not agree, the earlier terms continue for that subscription until it ends.
Governing law and disputes
These terms are governed by Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) and Swiss rules on conflict of laws do not apply. If you are a consumer, you still keep the protection of the mandatory laws of the country where you habitually live. In the EU, for example, Article 6 of the Rome I Regulation guarantees this.
If you are a consumer, you may bring proceedings in the courts of the country where you live or in Zürich, Switzerland. We may sue you only in the courts of your country, as the Lugano Convention and Swiss and EU law provide. For anyone who is not a consumer, the courts of Zürich, Switzerland, have exclusive jurisdiction.
We will gladly try to settle any disagreement directly; please write to us first. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
This website
The listening examples on raumo.app are recordings of Raumo’s audio engine, and the app demonstrations show the real iPhone app. Your browser does not compose a new performance: an example ends at its recorded length. In the app, the music evolves differently as you listen or change a room. See the sources and licences for the recorded examples. The website and its examples are for your personal information. The rules in The music and what you may do with it also apply to them.
Final provisions
If any provision of these terms is or becomes invalid, the rest stays in force. The invalid provision is replaced by the statutory rules.
You can send us notices by email. These terms are written in English. If we provide a translation, the English version applies, unless the mandatory law of your country provides otherwise.
